Crooksville Council Meeting Minutes   Monday, January 20, 2014                                                                                        

ROLL CALL:  Mr. Lantz called the meeting to order with the following members present Mr. Rice, Mr. Redfern, Mr. Hampton, Mr. Allen, Ms. Driggs, and Mr. Mohler. Tom Collins was present. Jan Baughman was absent. 

Corlyn Altier was present to give an EMS Update and to present Council with a new contract to look over. She stated that the revenue in 2013 was $328,338.43 and was up from 2012 where it was $289,481.66. She gave a recap of the EMS Billing and explained the recovery rate. She gave Council a new contract for the 2014 year and explained that the percentage that she will receive will stay the same and that it is exactly the same as last year.

MINUTES:  Motion to approve Clerk’s minutes was made by Mr. Mohler and seconded by Mr. Rice.  Motion carried.

APPROVAL OF REPORTS:  Motion to approve the Mayor’s Report for December was made by Mr. Rice and seconded by Mr. Mohler. Motion carried.

Motion to approve Clerk’s reports for December and for the 2013 Year was made by Mr. Mohler and seconded by Mr. Rice.  Motion carried. Mr. Redfern wanted Council to note that Income Tax for 2013 was down $63,724.00 from 2012.

PAID BILLS:  A motion to approve Resolution 2014-6 paid bills and payroll was made by Mr. Mohler and seconded by Mr. Rice. Motion carried.

TO BE PAID BILLS:  A motion to approve Resolution 2014-7 to be paid bills was made by Mr. Mohler and seconded by Mr. Hampton.  Motion carried.

TRANSFER:  A motion to approve Resolution 2014-8 transferring funds was made by Mr. Rice and seconded by Mr. Mohler.  Motion carried.

PARK & RECREATION COMMITTEE: Mayor Lantz asked Tom Collins if he checked on this. Tom stated that he had hoped Jan would be here tonight to ask Council if this was what they wanted for sure because the Municipal Building was purchased with Municipal Bonds. Mr. Mohler discussed the payoff dates on both the Municipal Building and the Rec Center. There was a motion to table the Rec Center refinance discussion by Mr. Rice and seconded by Mr. Hampton. Motion carried.

Mayor Lantz explained that Council had been given a comparison of 2012 and 2013 Revenue Breakdown report for the Rec Center. Brittany Ross explained what this comparison showed in relation to losses. Mr. Hampton explained the loss and what the problem is projected to be as well as what refinancing could do in regards to earning revenue. Tom Collins stated that maybe just get a separate loan for the Rec Center to get out from under the USDA regulations. Mayor Lantz and Tom Collins stated that she wants tracking of ethnicity and that this is the last year that she will give us a break.

Tom Collins informed Council that the Rec Center has a major problem. The sewage lines underneath the building have been unhooked for a while. In return, this means that there is raw sewage laying there. Council discussed what needed to be done in order to get this fixed. This was found when George Spears was trying to find a way to run the wires for the new cameras.

Mr. Mohler stated that both entrances to the Park have been closed during off season and people can still walk in. Mr. Mohler stated that it will be reopened by playing it by ear. This will be put on the run around channel that walk ins are okay but the park entrances have been closed to keep trash down and out. 

SERVICE COMMITTEE: Mr. Rice asked if all could be voted on at once for the trash hauling permits. Mr. Redfern stated that he will not vote if it will be done as a group.

A motion was made by Mr. Mohler and seconded by Mr. Rice to accept the trash hauling permit for Leckrone Sanitation. Motion carried. 

A motion was made by Mr. Mohler and seconded by Mr. Hampton to accept the trash hauling permit for Waste Management of Ohio. Vote went as follows: Mr. Rice yes, Mr. Redfern no, Mr. Hampton yes, Mr. Allen yes, Ms. Driggs yes, and Mr. Mohler yes. Motion carried. 

A motion was made by Mr. Hampton and seconded by Mr. Mohler to accept the trash hauling permit for B.A. Disposal. Vote went as follows: Mr. Rice yes, Mr. Redfern no, Mr. Hampton yes, Mr. Allen yes, Ms. Driggs yes, and Mr. Mohler yes. Motion carried.

A motion was made to accept the trash hauling permit for Boyd’s Sanitation by Mr. Rice and seconded by Mr. Hampton. Vote went as follows: Mr. Rice yes, Mr. Redfern no, Mr. Hampton yes, Mr. Allen yes, Ms. Driggs yes, and Mr. Mohler yes. Motion carried.

A motion was made to accept the trash hauling permit for Republic Services, Inc. by Mr. Rice and seconded by Mr. Mohler. Motion carried. 

Mr. Redfern stated that the reason he did not approve the three he voted no on was because they come in discriminately and do no obey the ordinances and pick up trash whenever they wish.

SAFETY COMMITTEE: A motion was made to accept Anthony Williams to the Part-Time EMS by Mr. Mohler and seconded by Mr. Redfern. Motion carried.

Chief Tysinger stated that he heard there was an issue with the shot guns that donated money will buy. He stated that the ones that he has is not safe and not up to date. Mr. Redfern stated that he looked at the shot guns today and he is now for the shotguns and does not recommend the old ones as being used for back up. Tom Collins stated that he thinks they need destroyed. Chief Tysinger stated that his game plan is to take the old guns to a gun dealer and with the money he gets out of this to buy all of the full time guys the same caliber hand guns so ammo can be shared. Chief Tysinger stated that three mounts would cost about $400 a piece and that this would be the only thing he would need to purchase.

BUILDING COMMITTEE: A motion was made to approve the sign permit for Little Joe’s Auto Service at 425 China Street by Mr. Rice and seconded by Mr. Hampton. Motion carried. Mr. Redfern asked if water and sewage was turned on at this business. Tom Collins stated that he was not sure if it was on or even hooked up. Mayor Lantz said that this would be checked on tomorrow. 

A motion was made by Mr. Mohler and seconded by Mr. Rice to accept the sign permit for Becky Messina (Crooksville Exchange) at 35 E. Main Street. Motion carried.  

LEGISLATIVE COMMITTEE:  A motion was made by Mr. Mohler and seconded by Mr. Hampton to accept the second reading of Resolution 2014-5, authorizing the Fiscal Officer to request an advance of taxes collected by the Perry County Auditor. Motion carried.

OTHER OLD BUSINESS: Mr. Redfern stated that he had been given a list by Officer Taylor with a list of bad properties in Crooksville. Chief Tysinger stated that he had a gentleman call him and ask if he would be classified as hauling trash if he is renovating and have a dumpster. Mr. Mohler stated that he would be doing this for a single person not for hire. Chief Tysinger stated that he would not be classified as hauling trash.

NEW BUSINESS: Motion was made by Mr. Rice and seconded by Mr. Mohler to pay overtime, in lieu of comp time, to employees that worked the sub-zero weather repairing water breaks on January 5th and 6th per Administrator’s Recommendation. Vote went as follows: Mr. Rice yes, Mr. Redfern no, Mr. Hampton yes, Mr. Allen yes, Ms. Driggs yes, and Mr. Mohler yes. Motion carried. Mr. Redfern explained that the reasoning of him voting no was because he did not want to open a can of worms or create a problem. 

Mayor Lantz stated that the next item on the agenda was a discussion on the ORC 705.13, Salaries and attendance of members. Mr. Rice stated that between the ORC and our Rules of Council, we have all of the rules we need; they just need to be enforced. He stated that if you don’t come to the meeting, you do not get paid without the absence being excusable. Mr. Mohler stated that this ORC does not need to be an amendment to the rules of Council but if Council wants to adopt this ordinance, they can.

CITIZENS COMMENTS/COMPLAINTS: Larry Mauller stated that the Service, Street, and Water department needs commended on their hard work. He stated that there has not been any time that people could not get up or down after a reasonable time and he really appreciates it. He stated that there are three senior citizens that are on oxygen that live on his street and that the squad is there frequently. Larry stated that he really appreciates all of the hard work they do and for keeping the streets cleaned up.

EXECUTIVE SESSION: A motion was made by Mr. Rice and seconded by Mr. Mohler to go into executive session per 122.21 (G) (1) Personnel. Motion carried.  

Council is out of executive session with decisions made. Mr. Mohler made a motion that starting Gary Ross will be suspended without pay for 10 days effective January 22, 2014 while Council pending consultation with the Village Solicitor and Mr. Rice seconded this motion. Motion carried.

ADJOURNMENT:  A motion to adjourn was made by Mr. Mohler and seconded by Mr. Rice. Motion carried.
