Crooksville Council Meeting Minutes Monday, March 3, 2014
ROLL CALL: Mr. Lantz called the meeting to order with the following members present Mr. Rice, Mr. Redfern, Mr. Hampton, Mr. Allen, Ms. Driggs, and Mr. Mohler. Tom Collins and Jan Baughman were present.
MINUTES: Motion to approve Clerk’s minutes was made by Mr. Mohler and seconded by Mr. Rice. Motion carried.
REPORTS: A motion was made by Mr. Mohler and seconded by Mr. Rice to approve the Mayor’s Reports for February. Motion carried.
PAID BILLS: A motion to approve Resolution 2014-15 paid bills and payroll was made by Mr. Mohler and seconded by Mr. Rice. Motion carried.
TO BE PAID BILLS: A motion to approve Resolution 2014-16 to be paid bills was made by Mr. Rice and seconded by Mr. Mohler. Motion carried.
TRANSFER: A motion to approve Resolution 2014-17 transferring funds was made by Mr. Mohler and seconded by Mr. Hampton. Motion carried.
PARK & RECREATION COMMITTEE: Mr. Hampton stated that there was a 6th and 7th grade dance that went well at the Rec Center and the kids had a good time. Mr. Hampton asked if the wiring was done on the cameras at the Rec Center. Tom stated that the bulk of the wires are run and George is working on it.
LEGISLATIVE COMMITTEE: A motion was made by Mr. Mohler and seconded by Mr. Hampton to suspend the rules for Ordinance 2485, amending the 2014 Appropriations as an emergency. Motion carried.
A motion was made by Mr. Mohler and seconded by Mr. Hampton to accept Ordinance 2485, amending the 2014 Appropriations as an emergency. Motion carried.
A motion was made by Mr. Mohler and seconded by Mr. Hampton to suspend the rules for Ordinance 2486, the Ohio Basic Code for 2014 as an emergency. Motion carried.
A Motion was made to accept Ordinance 2486, the Ohio Basic Code for 2014 as an emergency by Mr. Mohler and seconded by Mr. Rice. Motion carried.
Brittany explained that the next Ordinance that Council sees before them is in regards to a letter sent by the Ohio Department of Public Safety stating that this fund needs set up. The County was getting this money but now the individual municipalities have to have the fund set up and monitor it. A Motion was made to accept the first reading of Ordinance 2487, an Ordinance establishing indigent drivers interlock and alcohol monitoring fund by Mr. Mohler and seconded by Mr. Rice. Motion carried.
UTILITY: Mayor Lantz stated that the next thing on the agenda was a discussion on the proposed landlord/tenant utility billing rule. Tom stated that he felt Council might have discussions on this. Mr. Rice stated that this should be discussed after Jan had time to review it. Mr. Mohler stated that this is in regards to making the owner of properties obligated to pay for the water bill regardless of who lives there if the tenant does not. Tom explained that on this application, if an owner signs this, a lien can be put on this property and asked Jan if this was correct. Jan Baughman stated that this is done already and is the law. Tom explained further in detail a specific example where this was not done and stated that the way he understood it, a lien could not be put on a property if it is in someone else’s name. Jan thought that the bills went to both the landlord and tenant. Council discussed this more in detail about what needs to be done and what needs to be implemented for the Village. Jan Baughman stated that this application really just that the Owner gives up the right for the tenant to be billed and that if a tenant is not living in the property, then the water can be turned off and not turned back on until the previous bill is paid. This can only be done if no one is living there.
Mr. Rice made a motion to put the utility bills in the landlord’s name and this was seconded by Mr. Redfern. Vote went as follows: Mr. Rice yes, Mr. Redfern yes, Mr. Hampton no, Mr. Allen no, Ms. Driggs no, and Mr. Mohler no. Motion failed.
OTHER OLD BUSINESS: Nothing.
NEW BUSINESS: Mayor Lantz stated that Council has received a letter from the Arts Council stating that the Art Walk will be moved to Somerset and will no longer be in Crooksville.
Mayor Lantz stated that they also received a letter from an attorney pertaining to the Closure of Wilson Street. Jan Baughman asked what the plans were for the barrier that is up on Wilson Street. Mr. Mohler stated that it was going to cost over $80,000 to fix that wall. Tom Collins stated that by the letter it seems that there is more than that being questioned. Jan Baughman stated that she will get a hold of the attorney and find out some more information regarding this. She stated that she will have to pull the plat for this.

ADJOURNMENT: A motion to adjourn was made by Mr. Rice and seconded by Mr. Mohler. Motion carried.
