Crooksville Council Meeting Minutes   Monday, June 5                         2017

 

ROLL CALL: Mayor Redfern called the meeting to order with the following members present Mr. Rice, Mr. Locke, Mr. Hampton, Ms. Smith, Ms. Driggs and Mr. Mohler. Tom Collins and Jan Baughman were present.

MINUTES: Motion to approve Clerk’s minutes was made by Mr. Mohler and seconded by Ms. Smith. Motion carried.

APPROVAL OF REPORTS: Motion to approve June Revenue Adjustments to the 2017 Budget was made by Mr. Mohler and seconded by Mr. Locke. Motion carried.

CORRESPONDENCE AND MESSAGES: Mayor Redfern stated that the Mid-Ohio Food Bank would like to use the Village Park for the monthly food giveaway on the 2nd and 4th Tuesdays from noon to 1:30pm. Motion to approve the use of Village Park was made by Ms. Driggs and seconded by Mr. Rice. Motion carried.

SOLICITOR LIST: Jan stated that she doesn’t know if Council wants to discuss the Walnut Street properties in Executive Session. All three properties are thinking about possibly selling and the Village should get an appraisal.

PAID BILLS: A motion to approve Resolution 2017-39 paid bills and payroll was made by Mr. Mohler and seconded by Mr. Rice. Motion carried.

TO BE PAID BILLS: A motion to approve Resolution 2017-40 to be paid bills was made by Mr. Rice and seconded by Mr. Mohler. Motion carried.

TRANSFER: A motion to approve Resolution 2017-41 transferring funds was made by Mr. Mohler and seconded by Mr. Hampton. Motion carried.

PARK & RECREATION: Motion to accept the first reading of Resolution 2017-42, a Resolution Declaring Necessity for Levy of Tax in Excess of Ten Mill Limitation (2 Mill) was made by Mr. Rice and seconded by Mr. Mohler. Motion carried.

Motion to accept the first reading of Resolution 2017-42, a Resolution 2017-43, a Resolution Declaring Necessity for Levy of Tax in Excess of Ten Mill Limitation (3 Mill) was made by Mr. Mohler and seconded by Ms. Smith. Motion carried.

Peggy Higgins was present and stated that she received a call from Dawn Mills from Allwell Behavior Health and would like to hold a Public Pool Party from 6pm to 8 pm for Suicide Prevention/ Awareness. This would be held on August 3rd. The pool would close about 5:45pm for a break but Allwell Behavior will be paying the pool party fee. Council stated that they are good with this being done. There were two applicants today for lifeguards.

SERVICE: Motion to approve the purchase of a Coneqtec Asphalt Planer from Southeastern Equipment for $17,025 from Street, Water, and Sewer funds was made by Mr. Mohler and seconded by Mr. Rice. Motion carried.

SAFETY: Fire/EMS Chief Ralph Hill was present and stated that he would have some things next week but he has had a busy weekend.

BUILDING: Motion to approve building permit for Jerry & Amy Marolt at 216 E Main Street for a Privacy Fence was made by Mr. Mohler and seconded by Mr. Hampton. Motion carried.

Motion to approve building permit for Jason & Heather Hammer at 129 Moore Street for a Fence was made by Mr. Rice and seconded by Mr. Hampton. Motion carried.

Motion to approve building permit for Carlie Rambo at 313 Walnut Street for re-surfacing her driveway was made by Mr. Rice and seconded by Ms. Smith. It was decided that since this is on top of what was already in place, there will be no fee. Motion carried.

Motion to approve building permit for Darrell & Beth Lantz at 208 Keystone Street for a Chain Link fence was made by Mr. Mohler and seconded by Mr. Rice. Motion carried.

LEGISLATIVE: Motion to table the third reading of Ordinance 2588, an Ordinance Establishing Village Storm Water Fees was made by Mr. Hampton and seconded by Mr. Rice. Motion carried.

Motion to suspend the rules for Ordinance 2590, an Ordinance Amending the 2017 Budget and Appropriations as an Emergency was made by Mr. Mohler and seconded by Mr. Rice. Motion carried.

Motion to suspend the rules for Resolution 2017-44, a Resolution Amending Resolution number 2016-81 and Approving the utilization by Perry County, rather than the Ohio Department of Transportation, of Certain Village Property for bridge construction, without Paying over compensation therefore, and declaring it an Emergency was made by Mr. Rice and seconded by Mr. Mohler. Motion carried.

Motion to accept Resolution 2017-44, a Resolution Amending Resolution number 2016-81 and Approving the utilization by Perry County, rather than the Ohio Department of Transportation, of Certain Village Property for bridge construction, without Paying over compensation therefore, and declaring it an Emergency was made by Mr. Mohler and seconded by Mr. Rice. Motion carried.

UTILITY: Motion to table the termination of all taps exceeding the current tap fee of $2,000 to allow for further review by the Solicitor was made by Mr. Rice and seconded by Mr. Hampton. There was a draft letter attached for her to look over, which she explained did not make sense and she would have to look into this further and get back with Council to make sure there would be no equal opportunity violations. Tom asked her to redo this letter once it is looked over thoroughly. Motion carried.

Mayor Redfern explained that this will coincide with the waterline project so this needs to be done soon and not put on back burner. Solicitor Baughman explained that this will not be put on the back burner. She explained to Council that there is a stack of current projects that the Village has and only brought a portion of it and she is kept busy with it all.

Motion to approve not replacing the water services on vacant properties unless owner agrees to pay the minimum water/sewer rate was made by Mr. Rice and seconded by Mr. Mohler. Tom explained that this is only regarding vacant properties and not temporary termination. Tom asked Jan to verify if this could be applied to the current utility rules and regulations. She explained that it could be. Motion carried.

OTHER OLD BUSINESS: Nothing.

NEW BUSINESS: Nothing. 

CITIZENS COMMENTS/ COMPLAINTS: Nothing.

EXECUTIVE SESSION: Motion to go into executive session per ORC 121.22 (G) (1) for personnel, (G) (2) for real estate, and (G) (3) for possible litigation was made by Mr. Rice and seconded by Mr. Mohler. Motion carried.

 

Council is out of executive session with no decisions made.

ADJOURNMENT: A motion to adjourn was made by Mr. Rice and seconded by Mr. Mohler. Motion carried.
