Crooksville Council Meeting Minutes   Monday, June 16,                              2014

ROLL CALL:  Mayor Lantz called the meeting to order with the following members present Mr. Rice, Mr. Redfern, Mr. Hampton, Ms. Driggs and Mr. Mohler. Jan Baughman and Tom Collins were present. Mr. Allen was absent.

Bob McClain and his wife were present with their Attorney Steve Schnittke to discuss Wilson Street and if it can be fixed. There are bricks falling off of the wall holding up Wilson Street into Mr. McClain’s yard and he doesn’t want the wall to fall over into his yard. There was a proposal from Linn Engineering showing the estimate of fixing this from 2008 and what it is now with inflation. Tom Collins stated that this estimate was given to Council originally back in 2008 and the one presented today just shows the inflation in price. Attorney Schnittke asked if there were funds available to pay for this. Attorney Schnittke stated that he was going to get a hold of Kent Cannon to see if he could look at Wilson Street. Council discussed this in further detail with Attorney Schnittke and the McClain’s. It was decided that Council would look into what can be done in regards to funds and will discuss at the next workshop meeting.

MINUTES:  Motion to approve Clerk’s minutes was made by Mr. Mohler and seconded by Mr. Hampton.  Mr. Redfern asked if Kim’s Ice Cream should have had an outdoor venue permit instead of noise permit. Mayor Lantz stated that they filled out the noise permit. Motion carried.

REPORTS: Motion to approve Mayor’s report for May was made by Mr. Mohler and seconded by Mr. Rice. Vote went as follows: Mr. Rice yes, Mr. Redfern no, Mr. Hampton yes, Ms. Driggs yes, and Mr. Mohler yes. Motion carried.

Motion to approve Clerk’s Reports for May was made by Mr. Rice and seconded by Mr. Mohler. Motion carried.

Motion to approve June revenue adjustments for the 2014 Budget was made by Mr. Mohler and seconded by Mr. Hampton. Motion carried.

Motion to approve June expense adjustments for the 2014 Appropriations was made by Mr. Mohler and seconded by Mr. Rice. Motion carried.

PAID BILLS:  A motion to approve Resolution 2014-41 paid bills and payroll was made by Mr. Mohler and seconded by Mr. Hampton. Motion carried.

TO BE PAID BILLS:  A motion to approve Resolution 2014-42 to be paid bills was made by Mr. Mohler and seconded by Mr. Hampton.  Motion carried.

TRANSFER:  A motion to approve Resolution 2014-43 transferring funds was made by Mr. Mohler and seconded by Mr. Rice. Motion carried.

PARK & RECREATION COMMITTEE: Motion to accept the third reading of Resolution 2014-37, Resolution declaring necessity for levy of tax in excess of Ten Mill Limitation was made by Mr. Mohler and seconded by Mr. Hampton. Mayor Lantz explained that this is the renewal levy. Motion carried.

SERVICE COMMITTEE: Motion to approve having $50 deposit for use of new tables at Rec Center was made by Mr. Rice and seconded by Mr. Mohler. Mr. Redfern asked what this $50 deposit was for in regards to the number of tables being used. There was a discussion on who would be responsible for collecting the deposit and accountability for the tables being used. Motion went as follows: Mr. Rice yes, Mr. Redfern no, Mr. Hampton yes, Ms. Driggs yes, and Mr. Mohler yes. Motion carried.

SAFETY COMMITTEE: PoliceChief Walters was present and asked Council if it was possible to purchase a new uniform for Officer Joey Carr because he only has one. Council explained to him that this was at the discretion of the Mayor and not needed to be brought before Council.

BUILDING COMMITTEE: A motion was made by Mr. Rice and seconded by Mr. Hampton to approve the building permit for Ronald Miller at 615 E. Brown Street. Motion carried.

LEGISLATIVE COMMITTEE:  A motion was made by Mr. Mohler and seconded by Mr. Rice to accept the first reading of Ordinance 2490, an Ordinance declaring certain real property no longer needed for any municipal purpose and authorizing its advertisement for sale. This is Heritage Hall. Motion carried.

Motion was made by Mr. Mohler and seconded by Mr. Hampton to accept the third reading of Ordinance 2492, an Ordinance authorizing all actions necessary to effectuate an opt-out electric service aggregation program pursuant to Ohio Revised Code 4928.20; and directing the Perry County Board of Elections to submit the ballot question to the electors; and authorizing an agreement with an agent for such purposes. Motion carried.

Motion was made by Mr. Mohler and seconded by Mr. Hampton to accept Ordinance 2492, an Ordinance authorizing all actions necessary to effectuate an opt-out electric service aggregation program pursuant to Ohio Revised Code 4928.20; and directing the Perry County Board of Elections to submit the ballot question to the electors; and authorizing an agreement with an agent for such purposes. Motion carried. Mr. Redfern stated that he sit in a Council meeting for the Village of New Lexington and they are pursuing this as well.

Motion was made by Mr. Mohler and seconded by Mr. Rice to accept the third reading of Ordinance 2493, an Ordinance authorizing all actions necessary to effectuate an opt-out gas service aggregation program pursuant to Ohio Revised Code 4929.26; and directing the Perry County Board of Elections to submit the ballot question to the electors; and authorizing an agreement with an agent for such purposes. Motion carried.

Motion was made by Mr. Rice and seconded by Mr. Hampton to accept Ordinance 2493, an Ordinance authorizing all actions necessary to effectuate an opt-out gas service aggregation program pursuant to Ohio Revised Code 4929.26; and directing the Perry County Board of Elections to submit the ballot question to the electors; and authorizing an agreement with an agent for such purposes. Motion carried.

A motion was made by Mr. Mohler and seconded by Mr. Rice to accept the first reading of Ordinance 2495, the 2015 Budget. Motion carried.

A motion was made by Mr. Mohler and seconded by Mr. Rice to accept the first reading of Ordinance 2496, an Ordinance establishing the Police Training and Equipment Purchase/Replacement Fund and authorizing the Mayor’s approval of expenditures therefrom not exceeding $500. Motion carried.

A motion was made by Mr. Mohler and seconded by Mr. Rice to suspend the rules for Ordinance 2497, an Ordinance amending the 2014 Appropriations as an emergency. Motion carried.

A motion was made by Mr. Rice and seconded by Mr. Hampton to accept Ordinance 2497, an Ordinance amending the 2014 Appropriations as an emergency. Motion carried.

INSURANCE COMMITTEE: A motion was made by Mr. Rice and seconded by Mr. Redfern to approve McBane Insurance to obtain an insurance quote from the Ohio Plan. Motion carried.

OTHER OLD BUSINESS: Nothing.

NEW BUSINESS: Nothing.

CITIZENS COMMENTS/ COMPLAINTS: Nothing.

EXECUTIVE SESSION: A motion was made by Mr. Mohler and seconded by Mr. Rice to go into executive session per ORC 121.22 (G) (1) Personnel. Motion carried.

Council is out of executive session with no decisions made.

Mr. Redfern discussed the two way radios and the frequencies in regards to West Virginia. He stated that there should be no problem with this because of the distance and we can approve and send back. Mr. Redfern stated that the other thing is the water/ sewer license for the two way radio. Tom Collins stated that he thinks we should keep this.

Mr.Redfern stated that he has one other item to come before Council. He stated that he has received a couple of complaints in regards to the hedges at the corner of Walnut and Buckeye Street. They are grown so far out that when vehicles turn, the vehicles are getting scratched. He stated that they need to be cut and asked the Police Department if they would take care of this.

Ralph Hill stated that they are supposed to start installing his new siren on Wednesday at 7:30am. If they get everything hooked up and set up, they might be testing it that day.

Mr.Redfern asked about the digital box needed from Time Warner Cable in order to view the run around channel. He stated that he has had a couple of calls on this and needed to know what was going on with it. Mr. Mohler stated that in order to have this digital box, you have to get the digital box through Time Warner and they add the price to your bill.
