Crooksville Council Meeting Minutes Monday September 16, 2013
ROLL CALL: Mr. Mohler called the meeting to order. Mr. Rice, Mr. Redfern, Mr. Hampton, Mr. Allen, and Mr. Moore were present. Mayor Lantz and Jan Baughman were absent. Tom Collins was present.

MINUTES: Motion to approve the Clerk’s minutes was made by Mr. Moore and seconded by Mr. Rice. Motion carried.

APPROVAL OF REPORTS: A motion was made by Mr. Moore and seconded by Mr. Rice to approve the Clerk’s report for September. Motion carried.

A motion was made by Mr. Moore and seconded by Mr. Redfern to approve the September’s expense adjustments to the 2013 Appropriations. Motion carried.

A motion was made by Mr. Redfern and seconded by Mr. Rice to approve the September’s revenue adjustments to the 2013 Budget. Motion carried.

PAID BILLS: A motion to approve Resolution 13-58 paid bills and payroll was made by Mr. Moore and seconded by Mr. Redfern. Motion carried.

TO BE PAID BILLS: A motion to approve Resolution 13-59 to be paid bills was made by Mr. Hampton and seconded by Mr. Rice. Motion carried.

TRANSFER: A motion to approve Resolution 13-60 transferring funds was made by Mr. Rice and seconded by Mr. Redfern. Motion carried.

SERVICE COMMITTEE: A motion was made to approve the sign permit and gaming permit for Tim Nolan, Owner of HD Skilled Games at 230 W Main Street. Mr. Mohler stated that he has 22 machines and asked if it was paid for. Brittany Ross stated that he paid for the sign permit and gaming permit when he first applied and that it was being held until the permits were approved. Chief Tysinger stated that the background check would have been completed earlier but he had to reapply for it. A motion was made by Mr. Hampton and seconded by Mr. Rice. Motion carried.

BUILDING COMMITTEE: A motion was made by Mr. Hampton and seconded by Mr. Rice to approve the building permit for Randy & Debbie Willison at 420 Walnut Street. Vote went as follows: Mr. Rice yes, Mr. Redfern yes, Mr. Hampton yes, Mr. Allen yes, Mr. Moore no, and Mr. Mohler yes. Motion carried. Mr. Redfern stated that he feels that there is a fence issue and there is no regulation in regards to it. He stated that it needs put on the next workshop agenda to discuss and possibly an ordinance needs done to take care of this. Mr. Redfern stated that he feels when someone comes in to get a permit to build a fence they need to make sure that the water and sewer lines are clear in case the Village would need to get to it.

LEGISLATIVE COMMITTEE: A motion was made by Mr. Moore and seconded by Mr. Rice to accept the third reading of Ordinance 2465, an Ordinance Declaring Certain Property Surplus and Authorizing Its Sale. Motion carried.

A motion was made to accept the third reading of Ordinance 2466, a resolution adopting the revised personnel policies and procedures manual for the Village of Crooksville, Ohio by Mr. Redfern and seconded by Mr. Rice. Motion carried.

A motion was made by Mr. Rice and seconded by Mr. Redfern to accept the third reading of Ordinance 2468, authorizing the Village Administrator to declare personal property valued at $5,000 and less as surplus and to authorize and provide for its sale. Motion carried.

A motion was made by Mr. Rice and seconded by Mr. Redfern to suspend the rules for Ordinance 2469, amending the 2013 Appropriations and Budget as an emergency. Motion carried.

A motion was made by Mr. Rice and seconded by Mr. Redfern to suspend the rules for Ordinance 2470, an Ordinance amending ordinance number 2452, to additionally approve, adopt, and enact chapters 110 and 112, general provisions and peddlers, itinerant merchants and solicitors within title XI business regulations of American Legal Publishing’s Ohio Basic Code, 2013 Edition and declaring it an emergency. Motion carried. Chief Tysinger asked Council if this will include Boy Scouts or Girl Scouts. Mr. Mohler stated that they will be exempt as will all non profit organizations. Mr. Redfern stated that he will talk to Jan Baughman about getting this included in the Ordinance.

A motion was made to accept Ordinance 2470, an Ordinance amending ordinance number 2452, to additionally approve, adopt, and enact chapters 110 and 112, general provisions and peddlers, itinerant merchants and solicitors within title XI business regulations of American Legal Publishing’s Ohio Basic Code, 2013 Edition and declaring it an emergency by Mr. Rice and seconded by Mr. Hampton. Motion carried. Chief Tysinger asked if he could get a copy of this Ordinance to have for reference.

A motion was made by Mr. Redfern and seconded by Mr. Hampton to suspend the rules for Ordinance 2471, amending the 2013 Appropriations and Budget as an emergency. Motion carried. Brittany explained that this is additional to Ordinance 2469 and could not be added because a first reading was accepted on it and could not be changed. Ordinance 2471 added to what Ordinance 2469 had already changed.

A motion to accept Ordinance 2471, amending the 2013 Appropriations and Budget as an emergency was made by Mr. Rice and seconded by Mr. Redfern. Motion carried.

A motion to suspend the rules for Resolution 2013-61, accepting the amounts and rates for levies and current expenses for the Budget year 2014 was made by Mr. Rice and seconded by Mr. Moore. Brittany explained that this is what the County Auditor sent over on what the amounts should be for 2014 for real estate taxes and levies. Motion carried.

A motion was made by Mr. Hampton and seconded by Mr. Redfern to accept Resolution 2013-61, accepting the amounts and rates for levies and current expenses for the Budget year 2014. Motion carried.

UTILITY: Next, Mr. Mohler asked Tom Collins to discuss the AEP energy proposal. Tom stated that Mr. Redfern and Mr. Rice had been on the conference call with him. There was a discussion on what choice to go with to save the Village money on the electric bill. A motion was made by Mr. Rice and seconded by Mr. Moore to accept the AEP energy proposal for a 24 month period. The vote went as follows: Mr. Rice yes, Mr. Redfern yes, Mr. Hampton no, Mr. Allen yes, Mr. Moore yes, and Mr. Mohler yes. Motion carried.

A motion was made by Mr. Redfern and seconded by Mr. Rice to approve Holli’s probationary period and move her to $10.00/hour per agreement when hired. Motion carried.

OTHER OLD BUSINESS: Nothing.

NEW BUSINESS: Nothing.

CITIZENS COMMENS/COMPLAINTS: Joanne Boring asked Council what they decided in regards to fencing. She stated that the fencing goes to the sidewalk. Mr. Rice explained that the easement goes from the middle of the road to the property and that some people own the sidewalk in front of their house. Joanne stated that she had deed restrictions when she bought her property that prevented fencing from going up and now fences are going up all over town. She stated that something needs to be done because it is making the Village look bad. Mr. Rice stated that it will be discussed at the next workshop meeting.

Chief Tysinger stated that Officer Taylor is going to a free radar class in Ridgefield, Ohio and wanted to know if he will be reimbursed for the fuel instead of driving one of the Village’s vehicles. Mr. Rice stated that it was the Mayor’s decision on that. Chief Tysinger also stated that he has a law enforcement class to attend as well as a Mental Health training that is a week long. He stated that Officer Taylor has been working out at Crooksville Schools as a Resource officer on trial basis from 6:30am to 9:30am and 2:00pm to 4:00pm. He stated that Officer Taylor has training to go to and the School has agreed to pay for the training and hotel room.

Another citizen asked what happened with the rabbit problem. Chief Tysinger stated that some rabbits were disbursed and the owners only have 5-10 now to keep as pets.
